This paper aims at engaging with Baxi’s article “The Dust of Empire: the Dialectic Self-Determination and Re-colonization in First Phase Cold War” by arguing that self-determination, as defined during War, does not include indigenous peoples Cosmovision. Considering Amerindians were part economic pattern imposed to Third World period, “self” eurocentric lens self-determination excludes peoples’ selves condemns them being silenced, excluded, or extinct, is, permanent victims epistemicide. uses a deductive method based on bibliographic analysis discuss topic through perspectivism, well Fourth-World Approaches International Law (FWAIL).
